As a Data Processor

What information is being processed?

Data for processing is supplied by the client (the Controller) and will contain personal information.

Who is processing it?

The J Murphy representative involved in the commissioned work only.

How is it processed?

The data as provided by our data controller clients (for the purpose of performing their business requests), is held on our computers if supplied electronically, or in the office if the data is supplied by way of physical documents.  Our computers are password protected and the office is secure

How will it be used?

In the course of performing the requested business for our data controller clients, additional data is sometimes subsequently obtained or created, and such data is then held in specific files stored in Office 365 and/or contained within e-mails.

Once the business request has been completed, the clients’ original physical documents are returned:  In respect of electronic documents provided by the clients by way of electronic files, these are deleted.  Our electronic files containing data other than the clients’ physical or electronic files, are saved as files in Office 365 and kept for a period of 7 years.  Such data also includes invoices arising from the business request.

All other physical documents arising from the business request is securely shredded by Lyreco Office & Work Solutions in partnership with Restore Datashred and recycled.

Who will it be shared with?

As part of our business, some of this data will be provided to third parties, including the Court and opposing Solicitors and/or their costs representatives.

Our IT is managed by the company i-c-why consulting ltd.  In their role they have access to our network and files.  However, data is never removed from our network by them and all IT Management ‘sensitive’ information is stored in encrypted files on their network.

At no point is any data supplied by the Controller ever used, disseminated or sold. It is only ever used to complete the task set by the Controller.

What will be the effect of this on the individuals concerned?

There should be no effect on the individuals concerned.

Is the intended use likely to cause individuals to object or complain?

As the only the format of the data is related to the completion of the commissioned work, no objections are expected.

 

As a Data Controller

What information is being collected?

Sufficient information that is required to identify the individual/company for the production of an Invoice and update the client on work progress.

Who is collecting it?

Letter of engagement identifies personal information required for accounts and invoicing purposes.

How is it collected?

Directly from the client.

Data is not collected using: Observation, Derivation or Inference of systems, processes and other data.

Why is it being collected?

Only what is necessary to complete the commissioned work and create an Invoice.

How will it be used?

To complete the commissioned work and create an Invoice.

The data is not used for any other purpose including marketing of additional services.

If the client has consented, data will be retained to allow for additional future client work to be carried out efficiently.

Who will it be shared with?

The data collected is not shared with anyone not involved in the commissioned work or the management of the invoices.

As a Limited Company, the company accountants Chase Bureau have access to all invoices created by ‘J Murphy Cost Lawyers LLP’.

What will be the effect of this on the individuals concerned?

There should be no effect on the individuals concerned.

As the only use of the data is related to the completion of the commissioned work, no objections are expected.
